A defendant shall be punished by imprisonment for not less than eight months.

Facts of the cause of probation order [criminal facts]

1. On September 2, 2018, the Defendant and the person subject to a request to attach an attachment order (hereinafter referred to as “Defendant”) committed an indecent act by force on September 21, 2018, by returning the body of the victim D (the age of 64) from the stairs of subway No. 4 C Line No. 11 located in Yongsan-gu Seoul Metropolitan City, Yongsan-gu, Seoul, in the direction of the victim D (the age of 64).

2. The Defendant, at the time and place stated in Paragraph 1, committed the crime in Paragraph 1, committed an indecent act by force against the victim E (the victim E (the amb, amb, 27 years old) who was unsatisfing out of the stairs while escaping from the stairs after committing the crime in Paragraph 1 at the time and place.

3. On September 30, 2018, at around 20:17, the Defendant: (a) followed the victim H (a) who walked prior to the transfer passage of subway 3 lines G 1 lines in the Jongno-gu Seoul Metropolitan Government F, on September 30, 2018; and (b) committed an indecent act by force against the victim, following the victim’s h (a person, a person aged 23 years of age) on his/her own drinking.

[Fact of the ground for probation order] The defendant is likely to recommit a sexual crime in full view of the method and frequency of the crime, motive for the crime, the defendant's environment, character and conduct, etc.

1. In full view of the following circumstances revealed by the evidence adopted and examined by this Court, it is deemed that the Defendant is likely to recommit a sexual crime, taking into account the following circumstances, such as the character, conduct, environment, power, family relationship of the Defendant, motive and background of the instant crime, the method and content thereof, and the situation before and after the instant crime.
