A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 특수 폭행 및 특수 재물 손괴 피고인은 2015. 9. 4. 21:20 경 서울 강동구 C에 있는 'D' 중국 식당에서 술에 취해 별다른 이유 없이 욕설을 하는 등 행패를 부렸고, 이에 위 식당 종업원인 피해자 E(35 세) 가 피고인을 제지 하면서 위 식당 밖으로 데리고 나오자, 주먹으로 피해자의 얼굴 부위를 수회 때리고, 위험한 물건인 빈 그릇 및 음식물 등이 들어 있던 음식물 수거 통을 들고 피해자를 향해 던져 피해자를 쓰러뜨린 후 다시 발로 피해자의 몸통 부위를 수회 걷어찼고, 그 과정에서 피해자의 몸에 맞은 위 음식물 수거 통이 그곳에 주차되어 있던 피해자 F(36 세) 소유의 G 아반 떼 승용차에 맞게 하여 위 승용차를 수리 비 약 517,911원 상당이 들도록 손괴하였다.

Accordingly, the defendant, carrying dangerous things, assaults the victim E, and at the same time damaged the victim F's property.
