A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On May 8, 2014, between 11:52 and 12:18, the Defendant: (a) driven a rocketing car under the influence of alcohol without obtaining a driver’s license from the front side of the “D packing Ro-si” line in the same Dobcheon-si, to the front side of the building company (personnel training office) in the same Dobcheon-si, and again, driven a motor vehicle under the influence of alcohol without obtaining a driver’s license from around 2.2 km to the front side of the said D packing Ro-si.

2. On May 8, 2014, at around 12:45, the Defendant violated the Road Traffic Act (refluence of measurement) (i.e., the Defendant driven while under the influence of alcohol at “D-Packing Corlle” in Dong-si C, 2014, and received 112 reports as prescribed in paragraph (1). The Defendant was demanded to respond to the measurement of alcohol by inserting approximately 37 minutes in the influence of alcohol into a drinking measuring instrument, on the grounds that there are reasonable grounds to recognize that the Defendant driven while under the influence of alcohol, such as a string distance, etc. (i.e., a slope F, a driver of the Gyeonggi-do Police Station, a police station in charge of traffic control, and called out after receiving 112 reports.

Nevertheless, the defendant did not comply with a police officer's demand for alcohol testing without justifiable reason.

3. 폭력행위등처벌에관한법률위반(집단ㆍ흉기등협박) 피고인은 2014. 5. 8. 16:35경 동두천시 C에 있는 "D포장마차"에서 일행과 술을 마시고 있던 피해자 I(54세)에게 다가가서 "조금 전에 내가 음주운전을 하고 무면허인 사실을 신고했지 이 개새끼야!"라고 욕설을 하며 탁자 위에 있던 소주잔을 손으로 잡아 탁자에 내리쳐 깨뜨린 후 위험한 물건인 그 파편을 잡고 찌르려고 하면서 피해자에게 "이것으로 널 찌르면 난 5년만 살면 그만이다"라고 말을 하고, 계속해서 탁자 위에 있던 젓가락과 숟가락을 집어 들어 휜 다음 이를 손에 들고 피해자에게 "너의 배를 찔러 창자를 빼버리겠다 이 씹새끼야!"라고 욕설을 하는 등 피해자를...
