Reasons
Punishment of the crime
On October 12, 2009, the Defendant, at the Gangnam-gu Seoul Metropolitan Government Office, sold the victim G’s “Y” of 50,421 square meters of “Gangcheon-gun Hongcheon-gun H” (the actual shares transferred are 612/5, 214) to KRW 50 million and agreed to complete the registration of ownership transfer.
Pursuant to the above agreement, the defendant received the victim's land price as the price for the land from the victim, and the defendant's duty to implement the procedure for the registration of ownership transfer of the above land from the victim on October 12, 2009, 30 million won with the account (I) of F operated by the defendant, 10 million won on October 2009, 2000 won on October 21, 2009, 6 million won on October 21, 2009, and 4 million won on October 22, 2009.
However, on December 31, 2009, the Defendant borrowed KRW 450 million from J on December 31, 2009, and agreed to provide the above land as collateral and seven parcels, and completed the registration of creation of a neighboring mortgage of KRW 675 million with respect to each of the above immovables in the name of the said J at the Hongcheon District Court of Chuncheon on the same day.
이로써 피고인은 위 채권최고액 중 피해자에게 매도한 토지 면적에 해당하는 8,193,014원 부동산의 매도인이 매수인 앞으로 소유권이전등기 등을 경료하기 이전에 제3자로부터 금원을 차용하고 그 담보로 근저당권설정등기를 해준 경우에는 특별한 사정이 없는 한 매도인은 매수인에게 그 근저당권에 의하여 담보되는 피담보채무 상당액의 손해를 가한 것이라 할 것이므로, 이 사건 배임행위의 손해액은 피해자가 지급한 매매대금 전액이 아니라 위 근저당권의 채권최고액 중 피해자가 매수한 토지 면적에 해당하는 8,193,014원(≒612㎡/50,421㎡×675,000,000원)이다.
