1. The Plaintiff:
A. Defendant A Urban Development Project Cooperatives: KRW 2,052,00,000 and KRW 500,000 among them, respectively.
Reasons
1. Determination as to the cause of claim
A. 1) The Plaintiff is a company with the objective of urban planning planning design and supervision, etc., and Defendant A Urban Development Association (hereinafter “Defendant Association”).
(2) On May 30, 201, the Plaintiff entered into an urban development project research and design service contract (hereinafter “instant service contract”) with the Defendant Association on May 30, 201, and Defendant B and C jointly and severally guaranteed the Defendant Association’s obligations relating to the instant service contract, and the main contents of the instant service contract are as shown below.
Article 2 (Scope of Business) The content of business to be performed by the Epi Engineering Co., Ltd. (hereinafter referred to as “B”) under this Agreement shall be subject to the duties under paragraphs (1) through (23) below with respect to the area of D Day, area of 376,634 square meters in South-gu, South-gu, and the Urban Development Project Association Promotion Committee (hereinafter referred to as “A”).
1) Basic surveys, 2) the current status survey, 3) the soil survey, 4) the designation and development plan of the area (including urban management planning, etc.), 5) the basic design, 6) the prior examination of environmental impact, 7) the environmental impact assessment, 8) the traffic impact assessment, 9) the traffic impact analysis and improvement plan, 10) the examination of factors influencing disasters (administrative), 11), 12) the examination of factors influencing disasters, 13) the examination of natural landscape, 14) the surface examination of cultural properties, 15) the authorization of establishment of cultural properties, 17), 18) the planning plan, 19) the ex post facto environmental management, 20), 21), 23 (2) the completion inspection book, 23) the registration of the project plan, and 4) the modification contract shall be separately determined and implemented in this case.
