Defendant shall be punished by a fine of KRW 700,000.

When the defendant does not pay the above fine, 100,000 won.

Reasons

Punishment of the crime

The Defendant is an actual operator of Mapo-gu Seoul Metropolitan Government and 1217 C, who runs a distribution business with three full-time workers.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant had worked from July 28, 2014 to November 5, 2015 at the above workplace, and did not pay KRW 650,000 as wages of August 2015, 2015, KRW 1,300,000 as wages of September 2015, KRW 1,300 as wages of October 1, 2015, KRW 3,423,300 as wages of November 173,30 as well as KRW 3,423,30 as wages of November 20 without agreement on the extension of the payment term between the parties concerned.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant worked from July 28, 2014 to November 5, 2015 at the same place of business, and did not pay KRW 1,620,160 of D retirement pay within 14 days from the date of retirement, which is the date of the occurrence of the cause for the payment, without agreement between the parties on the extension of the due date.
