A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
The Defendant, while operating D golfweg stores located in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, provided that he would be able to repay the money through the sales of the above clothing store, while he provided that he would be able to repay the amount of KRW 350 million with the amount of 70 million,000,000,000,000,000,000,000 won.
1. On April 2017, the Defendant: (a) demanded that the Defendant would lend the Victim F with “I will pay KRW 30 million after one month.”
However, as above, the Defendant did not have any intent or ability to repay even if he borrowed the money from the victim because the Defendant bears a large amount of liability, etc. and paid at least KRW 13 million monthly interest.
Nevertheless, on April 13, 2017, the Defendant shown the above clothing store to the victim and received 30 million won in a de facto marital relationship with the Defendant from a new bank account (H) in the name of G in a de facto marital relationship with the Defendant on the same day.
2. On April 18, 2017, the Defendant stated that “A victim F may be repaid KRW 30 million,00,000,000,000,000,000,000,000 prior to the delivery of clothes to the victim F,” at the above clothing store, the Defendant lent KRW 20,000,000,000 to the victim F.
However, the defendant did not have the intention or ability to repay even if he borrowed money as provided in paragraph (1).
Nevertheless, the Defendant received 20 million won from the victim to the new bank account as described in paragraph (1) via E on the same day.
3. On September 12, 2017, the Defendant stated, “On September 12, 2017, the victim F was supplied clothes for the funeral of the memorial services from the head office to the victim F, so that the Defendant would be lent KRW 20 million.”
However, the defendant did not have any intention or ability to repay even if he borrowed money as stated in paragraph (1).
Nevertheless, the defendant described in paragraph (1) through E in the same day from the victim.
