1. The Defendants are jointly and severally and severally liable to the Plaintiff for payment of KRW 879,791,600 and the period from May 8, 2015 to January 13, 2017.

Basic Facts

The Plaintiff operates the building office and was in a transaction with Defendant C Co., Ltd. (hereinafter referred to as “C”), and Defendant C is a company established on August 17, 1989 for the purpose of leasing and selling real estate, and Defendant B is a person who actually operates Defendant C as seen later.

In around 198, the Plaintiff lent KRW 545,446,812 to Defendant C, such as paying a loan of KRW 350,00,000 to Defendant Samsung Life Insurance Co., Ltd., and Defendant C concluded a sales contract to sell nine units of the aggregate building he newly built in Daegu Northern-gu D on February 20, 1998, including KRW 610,617,908 (hereinafter “each building of this case”).

On June 24, 2004, Defendant C borrowed the debt amounting to KRW 11,821,000 in total (i.e., KRW 7,66,00 for KRW 7,66,00 from November 1, 2001 to June 2004 for KRW 11,821,00 for E architect office operated by the Plaintiff as the addressee (i.e., KRW 4,15,00 for KRW 7,66,00 for KRW 7,66,00 for the title of the National Pension and Medical Insurance Premium, and for KRW 4,15,00 for the name of the National Pension and Medical Insurance Premium) for KRW 7,66,00 for KRW 7,00 for KRW 7,66,00 for other employees who were incurred from around November 201 to June 204, 204, and (ii) for the debt amount stated in this document as “the primary premium”).

On March 11, 2009, Defendant B prepared a loan certificate (a evidence No. 7; hereinafter “second loan certificate”) that it borrowed from the Plaintiff as of December 31, 2009, with the maturity of KRW 36,645,000 from the Plaintiff as of December 31, 2009, which is determined as the first loan interest rate, and the above loan certificate was accompanied by the settlement statement that arranged the credit relationship between the Plaintiff and the Defendant B up to that time. The said settlement statement includes KRW 11,821,00.
