All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Facts of recognition;
A. The Plaintiffs shared the land of Jongno-gu Seoul Metropolitan Government 35.4 square meters and the 69.4 square meters of the Gu H large 69.4 square meters, and owned the land of Jongno-gu Seoul Metropolitan Government Jongno-gu H (marking in the register) wooden fixtures and the 52.89 square meters of the living facilities (storeing in the register) adjacent to the Subdivision (hereinafter “instant building”).
(Co-ownership shares are 1/6 shares of Plaintiff A and Plaintiff C and D, each of which is 2/6 shares. On the other hand, each share of Plaintiff C and D among each of the above lands was accepted in the I institution on July 17, 2020). The building of this case is operated by the business entity of “J”.
B. 1) The Jongno-gu Seoul Jongno-gu road 22.5 square meters (hereinafter “instant road”).
The Seoul Special Metropolitan City completed the registration of initial ownership on January 8, 1981. Of the instant building, part of the instant building is 11.3 square meters of the instant road (hereinafter “instant occupation and use”).
(2) The Plaintiffs were on the ground and obtained permission from the Defendant to occupy and use the said part of the road. The instant road is not a roadway connected to the Seoul Jongno-gu Seoul Metropolitan L Road. In addition to the instant building, part of the Jongno-gu Seoul Metropolitan Government Land Building (hereinafter “N,” a business entity of “N,” is running its business) is on the ground of the remaining part of the instant road of 11.2 square meters (2 square meters x 2.5 square meters x 11.3 square meters). The instant road is directly adjacent to the instant building.
C. 1) The Plaintiffs were the Defendant with respect to the occupation and use charges of the instant portion, KRW 13,362,250 for the year 209, KRW 14,045,90 for the year 201, KRW 14,045,90 for the year 201, KRW 14,045,90 for the year 201, KRW 15,164,60 for the year 2013, KRW 15,164,60 for the year 2014, KRW 15,164,60 for the year 2015, KRW 14,704,690 for the year 2016, KRW 14,704, KRW 690 for the year 2017, KRW 16, KRW 780 for the year 2017, KRW 15,90 for the year 207, and KRW 268,2016.
