Reasons
Punishment of the crime
No one shall distribute computer programs, apparatus or device not provided or approved by a game water-related business operator for the purpose of interfering with the normal operation of game products or produce them for the purpose of distribution.
On December 28, 2016, the Defendant produced “C”, which is an automated program that allows users of “Damben 3”, a mobile game operated by Nexson Korea, to repeat any specific act, such as automatic match, even though the users of “Damben 3,” which is a mobile game operated by Nexson Korea, at the office located in Busan-gu Busan-gu, Busan-do. Around December 28, 2016, the Defendant produced “C”, which is an automated program that is operated by the Defendant’s Internet site (D). The Defendant deposited KRW 35,00 won with the National Bank Account (E) of the Defendant’s name, paid the automation program at KRW 35,00, and made F available for one month by downloading the program from the above website to August 17, 2017, and deposited the same program with the Defendant’s total amount of KRW 37,000 from 35,700 to 87,570.
Accordingly, the suspect produced and distributed a computer program not provided or approved by the Net Game Business Co., Ltd. and Nexson Korea.
