Criminal facts
1. The Defendants’ status as Defendant A is a second class mate in charge of safe navigation in PP E (29,211 ton, 63 persons on board) of petrochemicals, Defendant B is a red bean corporation owned by Defendant E, F is a general manager of the whole town who is under overall command of trial operation in G (58,767 ton, 27 persons on board) where a trial operation was under way, and H is a domestic corporation owned by G.
2. On December 29, 2013, Defendant A’s duties and the actual vessel destruction Defendant: (a) shipped 30,258 tons of harmful liquid substances of three kinds, including 00:00 p.m. at Para-Xle, 20,216 tons, to E on December 29, 2013; (b) shipped 30,258 tons of hazardous liquid substances of three kinds, including 0,216 tons to E; and (c) sailed at the speed of 14.5 Em. on the same day at around 02:15, the sea of Busan Thai-dong, Busan Thai-dong, Busan at the speed of 9.2 Emb. on December 28, 2013.
However, since there is a high risk of collision due to frequent passage of vessels, there was a duty of care to prevent collisions by ascertaining information about the other party's vessel with navigational devices such as radars in advance and informing the moving of the vessel by sound signal, light signal, etc., and by changing the other party's angle before the close of the other party's vessel, avoiding collision and sailing at a safe speed.
