A defendant shall be punished by imprisonment for nine months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person engaging in driving service of a car B i30 vehicle.

On November 29, 2017, the Defendant driven the above vehicle at around 23:30 on the 29th day of November, 2017, and continued the intersection in the vicinity of the subordinate high school located in 39, southnam-si, Seoul, by straightening the intersection from the 1st day of the Dong community service center of the U.S. to the dong bank.

At the same time, there was a vehicle in the intersection where signal lights are installed, and thus, there was a duty of care to prevent accidents by thoroughly driving the vehicle in front and safely driving the vehicle in accordance with the signals.

Nevertheless, the Defendant did not discover the victim C driver's D taxi that was under normal course with green light at the time of the intersection due to the negligence of the failure to go straight, even though the signal while under the influence of alcohol was red, and did not discover the victim C driver's cab that was under normal course with green light, and shocked the part of the above i30 driver's cab as the front part.

Ultimately, the Defendant destroyed the above taxi and escaped without taking necessary measures at the site so that the amount equivalent to KRW 4,600,768 of the repair cost by negligence in the course of performing the above duties.

2. On September 22, 201, the Defendant was sentenced to a fine of five million won due to a violation of road traffic laws (driving), etc. at the Seoul Northern District Court (Seoul Northern District Court) around September 2, 201, and a fine of one million won due to a violation of road traffic laws (driving) at the same court on January 31, 2017, respectively.

On November 29, 2017, the Defendant driven B 130 automobiles while under the influence of alcohol with approximately 0.161% alcohol concentration 0.161% while under the influence of alcohol, from the roads near the Yellow City Center in the Hannam-si, Hanam-si to the intersection near the subordinate high school located in 165 in the Hannam-si.
