A defendant shall be punished by imprisonment for not less than one year and six months.

피고인은 2014. 8. 27. 16:00경 군산시 C에 있는 피고인이 근무하고 있는 ‘D’ 1층 사무실에서, 그 사무실 일부를 사용하기로 하고 이삿짐을 옮겨 짐정리를 하고 있던 피해자 E(50세)에게 “임시로 사용한다면서 왜 이렇게 짐이 많냐”고 한 것이 시비되어 피해자와 말다툼하던 중, 주먹으로 피해자의 얼굴 부위를 1회 때리고 한손으로 목을 잡고 조른 다음, 테이블 위에 있던 위험한 물건인 드라이버(손잡이 12센티미터, 드라이버날 18센티미터)를 집어 들어 피해자의 배 부위, 가슴 부위, 팔 부위를 각 1회 찌르고, 드라이버 손잡이 부위로 피해자의 어깨 부위를 수회 내려찍은 후, 피해자가 2층으로 도망가자 따라 올라가 라이터를 쥔 주먹으로 피해자의 머리부위를 수 회 때렸다.
