1. The Defendants are jointly and severally liable to the Plaintiff for KRW 40,000,000 and KRW 4,000,000 among them, from August 14, 200 to 30,000.
Reasons
1. The credit transaction agreements and loans, joint and several guarantee relations, judgments, the confirmation of assignment of claims and the amount of loans that have not been repaid, such as the grounds for claim recognition (Provided, That the debtor is "the defendant," and the creditor is "the plaintiff," respectively), and the credit transaction agreements and joint and several guarantee relations, judgments, assignment of claims and the amount of loans that have not been repaid, are not disputed between the parties, or the whole purport of the pleadings in each entry in Gap 1 through 6 (including each number).
2. Determination
A. According to the above facts, the defendants are jointly and severally liable to the plaintiff, and with respect to the plaintiff's 40,000,000 won (the sum of all principal of loans 1 through 5) and part of the principal of the first loan 4,00,000 among the above loans, the damages for delay shall be paid from August 14, 200 to 30,000,000 won, from October 14, 200 to 1,50,000 for part of the principal of the second loan 1,50,000 won, from October 11, 200 to 2,50,000 for part of the principal of the third loan 1,50,000 won, from part of the principal of the fourth loan 2,50,000 won from November 1, 20 to December 25, 200.
B. The representative liquidator C of Defendant A Co., Ltd. (hereinafter “Defendant Co., Ltd.”) argues to the effect that “C individual was not a representative director of the Defendant Co., Ltd. at the time of each of the instant loans, and is not involved in the Defendant Co., Ltd.’s representative director at the time of each of the instant loans, and thus liable is unreasonable.” However, the instant claim is not a claim against the Defendant Co., Ltd., nor a claim against C individual.
3. Accordingly, the Plaintiff’s claim against the Defendants is justified. Accordingly, the Plaintiff’s claim against the Defendants is accepted.
