Punishment of the crime
[criminal power] On August 10, 2017, the Defendant was sentenced to two years of suspension of the execution of imprisonment with prison labor for fraud, etc. at the Incheon District Court on June 18, 2017, and the judgment was finalized on August 18, 2017.
【Criminal Facts】
No person shall retain other person's credit card information detected by fraud or other improper means, or make a transaction by credit cards by using it.
The Defendant, at the same time, called the customer center of the victim C, obtained the right to open the door of the victim company owned by the victim company, and entered the bank, and confirmed the information of credit cards (F card G and H) kept for the purpose of oiling at the same place, and conspired to use cash for entertainment expenses, etc. by making cash payment by using the card without being provided with the actual goods or services, i.e., the "credit card tin" at the gas charging station and the oil station, i.e., cash return other than fees.
Accordingly, at around 23:20 on April 5, 2017, the Defendant and B obtained a total of 1,165,000 won and a total of 14 times from around April 8, 2017, in the manner described in the attached list of crimes in the attached Table of crimes, the Defendant and B traded with a credit card using another person’s credit card information identified by unlawful means, as if they were their card numbers. The credit card numbers discovered by such unlawful means as above, have the said employee settle 30,000 won as the principal price, and then have the said employee paid cash excluding the fee, and received the monetary benefits equivalent to the said amount.
