A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Around July 2018, the Defendant was liable for approximately KRW 50 million in the absence of any particular asset, and due to the Internet gambling, a dump truck was operated using a dump truck in the name of the former domicile, but regular income was not raised. In addition, around January 2018 to February 2, 2018, the Defendant was unable to normally proceed with the soil and sand transport business at the development site B of the military, which was going to progress around July 2018 due to the aggravation of funds, since it was difficult for the Defendant to use money for business expenses such as business expenses, etc., the considerable portion of the borrowed money was considered to be used as debt or gambling funds, and thus, it was difficult for the Defendant to normally continue to perform the above business due to the failure to pay the principal and interest of the loan.
Notwithstanding the above circumstances, the Defendant:
1. On June 16, 2017, the victim acquired KRW 41,140,00 in total from the victim nine times to July 13, 2018 in the same manner as shown in the attached Table of Crimes (I), by means of acquiring KRW 940,00 from the victim to the victim’s money in the same manner as in the attached Table of Crimes (I), by falsely stating that he/she would have the victim E repay the borrowed money within several months when he/she borrowed money in short of money to pay aggregate proceeds.
2. On August 2018, 2018, the victim G’s house located in Chungcheongnam-do, Chungcheongnam-do, Chungcheongnam-do, U.S.F. and the victim sent to the victim for the camping development project in the Y, borrowing KRW 20 million as the expenses incurred in carrying out the said project from the victim G, who believed that he/she will give the exclusive transport right to earth and sand generated from the said project and pay the borrowed amount within the several months.
