A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant and the victim B are married on November 9, 1997.

On May 19, 2016, the Defendant tried to engage in a marital relationship with the victim under the influence of alcohol at his/her own residence located in C at the time of macroscoping around 01:30 on May 19, 2016, but was rejected from the victim.
