A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. From around 2009, the Defendant was selected as a recipient of basic living expenses and received basic living expenses at the D Eup Office located in Ulsan-gun, Ulsan-gun, but was excluded from a recipient of basic living expenses during the mid-2012, the Defendant became aware of the complaints.

Around 12:00 on June 22, 2012, the Defendant resisted to the said D-Eup office, and filed an application for issuance of 100 copies of the instant D-Eup office with a public official belonging to the said Eup office, who is a public official belonging to the said Eup office, by stating that certain employees would take a meal, and that he would play a food at a certain place. The Defendant applied for issuance of 100 copies of the said D-Eup office.

이에 위 E으로부터 신분증 제시를 요구받자 "내가 누군지 다 아니까 발급하라."고 소리치며 소란을 피우다가 다시 등본 20통, 인감 20통에 대한 발급신청을 하여 이를 발급 받은 후 읍장실로 들어가서 등본 서류를 뿌리고, "개새끼들, 치우지마라, 치우면 다 뒤진다, 가만히 다 놔둬라."고 소리를 질렀다.

As a result, the defendant assaulted and threatened the above E, thereby hindering the legitimate execution of duties concerning civil petition affairs for about 30 minutes.

나. 피고인은 2012. 7. 4. 11:00경 위 D읍사무소에서, 위 읍사무소 소속 공무원인 지방사회복지서기보 F에게 "씹할, 읍장 어딨어, 읍장 나와."라고 소리를 지르다가 읍장실로 들어가서 탁자와 의자를 발로 차고, 위 F에게 "국수를 배달시켜라, 콜택시를 불러라."라고 말하며 소리를 질렀다.

Accordingly, the defendant threatened the above F, thereby hindering the legitimate execution of duties concerning civil petition affairs for about 20 minutes.

C. At around 12:30 on July 5, 2012, the Defendant applied for the issuance of a certificate of basic livelihood recipient to the above F at the above D Eup office. However, the Defendant expressed that the F was demanded to present his/her identification card, and that he/she reported G, a local administrative assistant of the F, and that he/she was seated above F, and that he/she entered an Eup room and raised the consignee.
