Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Reasons

Punishment of the crime

The Defendant is an employer who employs one full-time worker and executes the “D Open Site Development Project” located in Nam-gu, Nam-gu, Seoul at port.

1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant, on August 1, 2016, did not pay KRW 1,170,000, which was retired from the said workplace on July 1, 2016, to the extent that 14 days have not elapsed from the date of retirement without the agreement of the parties to the extension of the payment deadline.

2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and

Provided, That the payment date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, on August 1, 2016, the Defendant did not pay KRW 1,946,709, which was retired from the said workplace, to the lapse of 14 days from the date of retirement without the agreement of the parties to the extension of the payment deadline.
