Reasons

Punishment of the crime

The Defendant is a person who operates a real estate brokerage office under the trade name of “C Licensed Real Estate Agent” in B, and a broker’s fee for the housing brokerage is received from both clients, and one of them is entitled to receive 9/1,000 or less of the transaction amount in the case of sale and exchange, and 8/1,000 or less of the transaction amount in the case of lease, etc., and may receive within the amount prescribed by ordinances of local governments.

1. On June 28, 2017, the Defendant received 500,000,000 won (legal brokerage commission: D’s down payment of KRW 4 million, intermediate payment of KRW 4 million, KRW 12 million, and KRW 200,000,000 exceeding the statutory brokerage commission from G in mediating the transfer of D’s rental housing units to G at the office of the said licensed real estate agent) in excess of the legal brokerage commission.

2. On July 8, 2017, the Defendant received 500,000 won (legal brokerage commission: KRW 4 million in total, KRW 14 million in the J’s down payment, KRW 70,000 in the amount exceeding 0.5% in the amount of 14 million in the legal brokerage commission) exceeding the statutory brokerage commission from the said L, in mediating the transfer of the leased housing unit E, sold by J to L in Gwangju Nam-gu, Nam-gu, Gwangju, Seo-gu, which was sold by the Defendant in Seo-gu.

3.
