1. Defendant (Counterclaim Plaintiff): (a) KRW 25,225,000 to the Plaintiff (Counterclaim Defendant) and its related thereto, from July 26, 2019 to January 13, 2021.

1. Facts of recognition;

A. The Defendant is the owner of Kugung-gu C large 454m2 on the above land, and is the owner of the construction project that newly constructs a living facility near the fourth floor above the above land (hereinafter the building of this case) (hereinafter the “public building of this case”).

B. On April 25, 2018, the Defendant obtained a building permit for the instant building, and the designer and supervisor of the instant building were D (trade name E architect), but, during seeking construction methods, requested the Plaintiff to provide and review the design books and the building owner’s additional requests (28 items) while seeking construction methods, and received a written statement of the unit price of construction works from the Plaintiff.

위 공사 실행 단가 내역 서에는 샷 시 창호, 목공 ㆍ 철근 ㆍ 콘크리트 공사, 전기공사, 설비공사, 레미콘물량, 철근물량, 인테리어 자재, 도장공사, 위생기구 및 타일 공사, 싱크 및 가구공사, 석재 공사, 도배 ㆍ 장판공사, 기계 미장공사, 경비 및 기타 철물( 스티로폼 ㆍ 가림 막 ㆍ 시멘트 ㆍ 모래 등), 마당 포장 등 항목 별로 각 금액이 기재되어 있고( 그중 상당수는 “ 예상” 이라고 기재됨), 기타 예상 단가로서 난방 LPG 탱크 및 배관 설치, 수도 ㆍ 배수설비, 고용 산재보험, 안전 발판 ㆍ 중간층 안전비계ㆍ가림막에 각 금액이 기재되어 있었는데, 총금액은 390,690,000원이었다.

On October 16, 2018, the Plaintiff and the Defendant concluded a contract under which the Defendant appointed the Plaintiff as an on-site agent (hereinafter referred to as the “instant contract”) to construct the instant building as a direct owner of the building, and the content of the contract (hereinafter referred to as the “instant contract”) is as follows:

This Agreement calls for the following paragraphs to appoint on-site agents (hereinafter Plaintiff D) and their assistants in order to build a neighborhood living facility for the direct management of the owner of the building:
