A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

No person shall keep, deliver or distribute access media with the knowledge that such media will be used for a crime.

피고인은 2016. 7. 중순경 전기통신금융 사기( 보이스 피 싱) 범죄조직으로부터 타인 명의의 접근 매체를 전달 받아 보관하면서 해당 계좌에 입금된 편취 금원을 인출하여 전달하고 수수료를 받는 소위 ‘ 인출 책’ 역할을 할 것을 마음먹고, 이를 위하여 2016. 8. 8. 23:00 경 서울시 관악구 신림동 이하 불상지에서 메신저 위 챗 (WeChat) 대화명 ‘C’ 을 사용하는 성명 불상의 상선의 지시에 따라 우체국 체크카드( 카드번호 D) 1매, 농협은행 현금카드( 카드번호 E) 1매, 국민은행 체크카드 (F) 1매, 기업은행 체크카드 (G) 1매, 새마을 금고 체크카드 (H) 1매 등 접근 매체 5매를 전달 받아 보관한 것을 비롯하여, 그때부터 2016. 8. 11. 13:28 경까지 사이에 범죄에 이용될 것을 알면서 별지 범죄 일람표 기재와 같이 3회에 걸쳐 접근 매체 총 30매를 전달 받아 보관하였다.
