A defendant shall be punished by imprisonment for one year.

Punishment of the crime

A person who is the general responsibility of the telecommunications-based financial fraud (hereinafter referred to as "scam") organization shall organize various stages, such as deceptions, management measures, and cash receipt measures. An employee under the deception is committing a crime by making an unspecified number of victims, by making a false statement, such as inducing a financial institution, etc. to make a loan at low interest, by misrepresenting himself/herself to a large number of unspecified victims, and allowing them to deposit into the account designated by the victims. An employee under the management measures shall collect cash receipt books and cash withdrawal books (name of the passbook), and by making cash withdrawals to deposit money with the account to make cash withdrawals, and transfer cash receipt books to the account to a cash receipt book.

On March 2018, the Defendant: (a) received a proposal from a person who was aware of “A” in the open-raising bank “B open-raising” (hereinafter “C”) to the effect that “I would receive money from a purchaser of bitcoin to transfer the money to the company; (b) would receive 1% of the face value of the transfer to the company; and (c) received specific instructions from the purchaser of bitcoin, while knowing that it was illegal, I would like to play a role as a liability for cash receipt of the phishing crime.

On June 14, 2018, when the victim E calls from the victim E at a noon place and misrepresents himself/herself to the victim E at a financial institution, he/she makes a false statement to the victim E, and consequently, he/she makes the victim transfer KRW 20 million to G account (H) in the name of F at around 12:53 on the same day. On the other hand, on the same day, the victim shall make the F make a loan by making the details of the withdrawal from the deposit at KRW 20,000,000,000,000 won, excluding KRW 19,99,000,000,000,000 won, and it shall be delivered to the sender by us.”
