The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for three years.

1. Summary of grounds for appeal;

A. misunderstanding of facts and misapprehension of legal principles did not have the intention to kill victims.

B. The sentence of the lower court’s improper sentencing (five years of imprisonment) is too unreasonable.

2. Determination

A. As to the assertion of misunderstanding of facts and legal principles, the Defendant asserted to the same effect as the lower court.

In full view of the following circumstances acknowledged by the evidence cited by the lower court, the lower court, at the time of the instant crime, committed the Defendant’s intentional murder.

The decision was determined.

① On October 7, 2017, on the ground that the Defendant refused to offer a proposal that he/she would drink around 18:40, he/she was in a department of e by avoiding disturbance, such as taking a bath to the surrounding persons, and taking the her blick with the victim E, etc.

② The Defendant concealed knife his knife in his house without any transfer, and sought victims at around 19:00 on the same day.

Although F, G, etc., upon receiving the victim E’s request for relief, the Defendant was faced with a knife, but the Defendant did not set the knife, and eventually, the Defendant took the direction of the head of the said victim’s knife in a knife and free state.
