A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On June 2015, the Defendant purchased one dump truck in the name of the Defendant’s spouse in the name of KRW 42 million, and registered the said truck in the name of the said C, and operated the said truck by borrowing KRW 54 million from the NH Capital as collateral from the NH Capital.

Defendant 1 entered into a contract to transfer the victim E and the above truck to KRW 33 million (including the amount including rights to business license plates) at the location in the East Sea on September 2015, and received part of the purchase price per 150,000 won per month from the damaged party for the payment terms and conditions of the payment, and agreed to deliver the name of the above truck to the injured party at the same time with delivery of KRW 15,00,000,000 from September 2016, and immediately deliver the above truck to the injured party.

On September 29, 2016, the Defendant received a demand from the injured party to transfer the remaining truck name at the same time in accordance with the above agreement, but failed to repay the loan, and was urged by the staff of the capital capital without his/her name to steal the above truck. On September 28, 2016, the Defendant arbitrarily removed the license plate of the above truck parkeded by the victim in the F, and removed it from it on September 28, 2016. On September 29, 2016, the Defendant sent the above truck key to the NH capital employee without his/her name at the same place and caused the said employee to go with the said truck with the same truck at a non-place.

As above, Defendant thefted a dump truck’s car number plate and dump truck owned by Defendant C, respectively.
