A defendant shall be punished by imprisonment for six months and by a fine of 100,000 won.
If the defendant fails to pay the above fine, 50.
Reasons
Punishment of the crime
1. On October 17, 2020, the Defendant, at around 01:00, 01:00, took a bath at the “D” drinking house operated by the Victim C in Gyeonggi-si B, with a large voice without any reason under the influence of alcohol, and was unable to avoid disturbance for about 45 minutes, such as refusing to calculate the amount despite the victim’s demand.
Accordingly, the defendant interfered with the victim's drinking house operation by force.
2. The Defendant violated the Punishment of Minor Offenses Act: (a) was provided with food equivalent to KRW 28,500 won in total at the time and place specified in paragraph (1); (b) at the time and place specified in paragraph (1); (c) at the victim’s price equivalent to KRW 13,00,000 in the market price; and (d) at the increase of KRW 8,500 in the market price; and (e) did not pay a value without justifiable grounds.

The reason for sentencing under Articles 70(1) and 69(2) of the Criminal Act is that the Defendant had been punished several times as a crime of interference with business, and in particular, the Defendant committed the instant crime of the same kind without being aware during the suspension period, and did not make any effort to recover from damage, and considering such factors as the fact that the Defendant led to the confession of the instant crime while committing the instant crime.
