The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. The defendant asserts that: (a) the defendant does not have a position to direct and supervise with the victim E; and (b) the victim, while making the victim aware of the victim at the time of the instant case and doing so, he would be aware of the victim after the instant accident; and (c) the victim would have been expected after the victim, etc., in a timely manner, he would be aware of the victim; (d) although the victim expressed his intention of refusal, he did not immediately act but did not commit an indecent act against the victim, such as by inserting the victim’s hand into the victim’s name.
B. As the defendant did not agree to the changes in the indictment, it is inappropriate for the court below to permit the prosecutor to do the changes in the indictment, since the prosecutor's improper assertion of the changes in the indictment made orally in the court below is not identical to the charges, and the defendant did not agree to the changes in the indictment.
2. Determination
A. In light of the difference between the first instance court and the appellate court’s method of evaluating the credibility of a statement made by a witness of the first instance court in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or there are extenuating circumstances to deem that the first instance court clearly erred in the credibility of a statement made by a witness of the first instance court in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or that maintaining the first instance court’s decision on the credibility of a statement made by a witness of the first instance court is remarkably unreasonable in full view of the results of the first instance court’s evidence examination and the results of additional evidence examination conducted by the time of closing argument at the appellate court, an appellate court shall render the first instance judgment on the credibility of a statement made by a witness
