A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

[criminal records] The Defendant was sentenced to one year of imprisonment on September 14, 2017 by the Seoul Central District Court for the crime of embezzlement, etc., and on July 23, 2018, at a public prison on July 23, 2018, he/she had ten the same past records.

[Criminal facts]

1. Embezzlements of deserted articles in possession;

A. From July 30, 2018, around 02:00 on July 30, 2018, the Defendant embezzled the deserted articles in possession against the victim B, even though he/she acquired a copy of E e-mail card (F) lost by the victim B located far from the D church located in Dongjak-gu Seoul Metropolitan Government, he/she did not take necessary procedures, such as returning the victim to the victim, and did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

B. Around 01:00 on September 7, 2018, the Defendant: (a) on the part of the victim G, the victim G, who was far away from the D church front parking lot located in Dongjak-gu Seoul Metropolitan Government, found one of his/her cell phones 200,000, but did not take necessary procedures, such as returning to the victim; (b) but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

around 04:00 on September 30, 2018, the Defendant: (a) the victim I, who was located on the front road of the Dongjak-gu Seoul Metropolitan Government J apartment, was lost, but did not take necessary procedures, such as returning the victim to the victim; and (b) the Defendant was able to have the victim.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

The Defendant, at around 01:00 on October 5, 2018, did not take necessary procedures, such as returning to the victim, even though the victim M lost cash 80,000 won, E-mail card (O) 1, and K card 1, which was located far from N in Dongjak-gu Seoul Metropolitan Government N, obtained one wall with which the market price cannot be known.
