1. The Plaintiff:
A. From March 24, 2015, Defendant AWn City Development Co., Ltd.: KRW 95,000,000 and its amount.
Reasons
1. Facts of recognition;
A. On March 23, 2012, Defendant AWn City Development Co., Ltd. (hereinafter “Defendant AWnd City Development Co., Ltd.”) entered into an international trust agreement with an international trust company (a trust company including mutual change to an international asset trust company, mutual change to a trust company, and mutual change before and after the mutual change) while carrying out the business of selling D officetels built on the land outside Gwangju-gu, Seo-gu and four parcels, which is owned by the execution company.
(2) The trust agreement of this case is based on the following: (a) the trust company manages the ownership of an officetel business site; and (b) if an officetel is newly constructed and registered for preservation in the future, the officetel ownership is also managed by the trust company; (c) only the trust company has the authority to sell the officetel and the sales price shall be deposited into the management account opened by the trust company; and (d) the sales contract without the seal of the trust company
B. On March 23, 2012, the trust company completed the registration procedure for transfer of ownership based on the trust regarding the entire project site of officetels, and completed the registration for transfer of ownership based on the name of the Defendant company on September 14, 2015 with respect to the completed Dtel 225, and the registration for transfer of ownership based on the trust was completed under the name of the trust company on October 5, 2015.
In addition, the registration of ownership preservation in the name of the defendant company was completed on November 27, 2015, the registration of ownership preservation in the name of the trust company, and the registration of ownership transfer in the name of the trust company was completed on the same day.
C. On March 19, 2015, the Plaintiff, a practicing licensed real estate agent, concluded a sales contract with the Defendant Company for each of the instant officetels at KRW 47,50,000 per heading room (sale price is KRW 70,90,000 per heading room).
The plaintiff shall pay 3,000,000 won each down payment.
