A defendant shall be punished by imprisonment with prison labor for up to eight months and a fine of up to two million won.

When the defendant does not pay the above fine.

Punishment of the crime

On July 1, 2016, the Defendant was sentenced to six months of imprisonment and a fine of three million won in violation of the Act on the Protection and Observation of Specific Criminal Offenders and Electronic Monitoring, etc. at the Daejeon District Court on July 1, 2016, and completed the execution of the sentence in the official prison on October 28, 2016.

Criminal facts

On June 4, 2013, the Defendant was issued an order to attach an electronic tracking device to the location tracking device for five years in the Daegu District Court Kimcheon.

1. No person who has an electronic device subject to attachment of an electronic tracking device shall arbitrarily separate or damage the electronic device from his/her body during the period of attachment of the electronic device, interfere with propagation, alter data received, or impair its utility by any other means;

Nevertheless, on January 24, 2017, the Defendant: (a) carried the electronic tracking device with a location tracking device around 10:00 and carried out the electronic device; (b) did not charge the device by locked it in the amblingel located in Daejeon Dong-gu, Daejeon; and (c) did not charge the device by locking it in the amblingel located in the amblingel located in Daejeon-gu, Daejeon; (d) thereby impairing the utility of the electronic device on January 25, 2017.

2. On July 21, 2015, the Defendant violated the order of restriction on outing, issued by Daejeon District Court an order from 24:00 each day to 05:00 of the following day to take out the outside of the residence of the person wearing an electronic device during the period of electronic device attachment.

Nevertheless, on November 20, 2016, from around 00:00 to 05:16, the Defendant went out from the Defendant’s residence located in Daejeon Dong-gu B and 101 Dong301 Dong-gu, Daejeon, and violated the Defendant’s order of restriction on going out during a specific time period, including night, in the same manner as written in the daily list of crimes, from around that time to January 25, 2017.

3. The Defendant, failing to comply with the instruction and supervision of the protection observation officer on November 20, 2016, by failing to comply with the instruction of the protection observation officer from 24:00 to 05:00 the next day without justifiable grounds, and received a written warning under Article 38 of the Act on the Protection, Observation, etc. of Daejeon Protection, Etc. on November 21, 2016.
