1. The Plaintiff:
A. Defendant B’s real estate listed in the separate sheet No. 3;
B. Defendant C shall set out in the separate sheet No. 4.
Reasons
1. Determination on the cause of the claim
A. (1) Under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents, the Plaintiff received the authorization for the establishment of a housing redevelopment project association on December 17, 2010, the Housing Redevelopment and Improvement Project Association approved for the establishment of a project from the Suwon City on June 29, 201, and the authorization for the management and disposal plan and public notice on August 25, 2017, respectively.
(2) Defendant B is the owner of the real estate listed in the separate sheet No. 3 in the project implementation district (hereinafter “instant three real estate”), Defendant D is the real estate listed in the separate sheet No. 5 (hereinafter “instant five real estate”); Defendant F is the real estate listed in the separate sheet No. 10 (hereinafter “instant real estate”); Defendant G is the owner of the real estate listed in the separate sheet No. 11 (hereinafter “instant real estate”); Defendant I, and Defendant J is the co-owner of the real estate listed in the separate sheet No. 13 (hereinafter “instant real estate”), each of which owns one-half shares of the real estate listed in the same list No. 13 (hereinafter “instant real estate”) and became the object of cash liquidation by failing to file an application for parcelling-out with the Plaintiff.
(3) 피고 C은 이 사건 3 부동산(별지 목록 제4 기재 부동산과 동일하다) 중 1층 우 K주점 12.89㎡(이하 ‘이 사건 4 부동산’이라 한다)의, 피고 E는 별지 목록 제7 기재 부동산 중 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉠의 각 점을 순차 연결한 선내 2층 좌 부분 40.47㎡(이하 ‘이 사건 7 부동산’이라 한다)의, 피고 H는 별지 목록 제12 기재 부동산 중 2층 57.87㎡(이하 ‘이 사건 12 부동산’이라 한다)의 각 임차인이다.
E. Meanwhile, the Plaintiff filed an application for adjudication of expropriation with the Gyeonggi-do Regional Land Expropriation Committee under the Act on Acquisition of and Compensation for Land for Public Works Projects (hereinafter “Public Works Act”) regarding each of the instant real estate, and the said Land Expropriation Committee filed an application for adjudication of expropriation on October 1, 2018.
