A defendant shall be punished by imprisonment for one year.

그럼에도 피고인은 2013. 10. 25. 14:00경 서울 마포구 C에 있는 피고인이 운영하는 주식회사 D 가구점에서 피해자 주식회사 장수산업(이하 ‘피해자 회사’)이 전기돌침대 등을 지정상품으로 하여 특허청에 제0610726호로 상표등록한 ‘장수돌침대☆☆☆☆☆’ 등록상표와 동일한 상표를 전기돌침대에 부착하여 판매한 것을 비롯하여, 2010. 3. 12.부터 2013. 11. 4.까지 별지 범죄일람표와 같이 121회에 걸쳐 피해자 회사의 등록상표와 동일하거나 유사한 상표가 부착된 전기돌침대 등을 판매하여 피해자 회사의 상표권을 침해하였다.
