A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who provides Internet computer game facilities in the name of “DPC room” in the first floor of Gangdong-gu Seoul Metropolitan Government with five main body of computers and monitors and ancillary facilities.

1. Any person who intends to run the business providing Internet computer game facilities shall register with the head of a Si/Gun/Gu after being equipped with the facilities prescribed by Ordinance of the Ministry of Culture, Sports and Tourism;

Nevertheless, from February 1, 2014 to May 27, 2015, the Defendant installed the first floor of the building of Gangdong-gu Seoul Metropolitan Government, and five new games (for example, E, Baduk: F, Makis: G) with five computers downloaded. The Defendant received cash from a large number of unspecified customers who found the said businesses, and had them run the said games by shocking them.

Accordingly, the defendant did not register with the competent authorities and provided the Internet computer game facility business.

2. No one shall allow anyone to gamble or perform other speculative acts by using game water, or leave him/her to do so;

Nevertheless, the Defendant received cash from many unspecified customers at the date, time, and place mentioned in paragraph 1, and issued 10,000 won, and provided 7% of the charged amount to the account of the customer who entered the scoos scoos into the game machine, and acquired 7% of the charged amount as a commission, and let the customer perform the said game machine (scoos, Baduks, scoos, and scoos), and let the customer perform the speculative act by having the customer exchange the points obtained as a result of the game using the telephone number on the screen on the basis of the game machine.
