1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

The lawsuit of this case is an objection to the judgment on which a provisional execution declaration of the Changwon District Court 2013Gahap2757 was attached. The lawsuit of objection is premised on the valid existence of executive titles, and it is not a lawsuit to challenge the existence of executive titles or to discard them. Thus, with respect to the judgment with a provisional execution declaration, the lawsuit of objection cannot be brought, regardless of the filing of an appeal, with regard to the existence of executive titles or seeking the abandonment thereof.

Therefore, since the lawsuit of this case is unlawful, it is decided to dismiss without holding any pleadings, and it is so decided as per Disposition.
