A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2014. 6. 8. 15:00경 천안시 서북구에 있는 천안서북경찰서에서, “2014. 6. 4. 오전 11시경 C이 ‘내가 수배중인데, 하루만 있게 해 달라’면서 집 안으로 들어와 피고인과 대화하던 중 오후 3시경 ⑴ 갑자기 피고인의 청바지를 벗기고 피고인과 강제로 성행위를 하려고 하다가 손님이 찾아오는 바람에 행위를 멈췄고, ⑵ 손님이 나간 직후 갑자기 피고인의 배 위로 올라와 양 팔목을 잡고, 발로 피고인의 허벅다리를 누른 뒤 몸이 피곤하여 항거불능 상태에 있던 피고인의 하의를 모두 벗기고 1회 간음하였으니 처벌하여 달라”는 취지로 고소장을 제출하고, 위 경찰서 여성청소년과에서 고소인 조사를 받으면서 위와 같은 취지로 진술하였다.

The reason for sentencing under Article 62(1) of the Criminal Act is that the defendant has a sexual intercourse under the agreement with the victim, but it is very poor in that the defendant filed a false complaint against the victim under the Act on Special Cases Concerning the Punishment of Sexual Crimes, etc., which is entirely different from the fact, thereby creating a false victim, and thus, has a risk of overcoming the judicial action of the State.
