1. The Plaintiff is running a fish farming and a fish farming business in the north-gu, Northern-si (hereinafter “instant farm”).

From April 2009, Defendant AS Construction Co., Ltd. (hereinafter referred to as “SS Construction”) was performing construction works for the second section of the construction site from among the D Railroad Works in the East Sea Line D (hereinafter referred to as “instant construction works”).

From December 6, 2013, Defendant Promotion Enterprise Co., Ltd. (hereinafter “Promotion Enterprise”) contracted with Defendant Korea Rail Network Authority for the Ethical Railroad Corporation among the D Railroad Corporation in the East Sea Line D (hereinafter “instant Human Railroad Corporation”) from Defendant Korea Rail Network Authority (hereinafter “instant Human Railroad Corporation”) and performed the instant labor team construction and human railroad construction by adding up the instant labor team construction and human railroad construction.

On December 30, 2015, the Plaintiff filed a civil petition for noise and vibration with Defendant DaS Construction and Promotion Enterprises at each of the construction sites of this case, following the death of some chickens and pigs at the farm of this case.

Accordingly, around January 7, 2016, Defendant Promotion Enterprise measured whether noise and vibration occurred in the instant farm in the presence of the Plaintiff.

On March 2016, the Plaintiff received noise and vibration civil petition from Defendant Korea Rail Network Authority, and sent the content-certified mail filing a civil petition against Defendant AS Construction.

The Plaintiff filed a civil petition for damages caused by noise and vibration on three occasions on January 4, 2016, May 2016, and January 13, 2017, even with the Port Viewing Livestock Department.
