A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On August 26, 2014, the Defendant was sentenced to two years of imprisonment for fraud in the Gwangju District Court's Netcheon Branch, and completed the execution of the sentence on April 10, 2016.

[2017 Highest 5766] On September 16, 2017, the Defendant was transferred KRW 150,000 on the same day from the victim’s agricultural bank account, on the Internet, to the victim D, who reported to the effect that he/she did not have any intent or ability to send the goods even if he/she received money from another person.

From that time to December 6, 2017, the Defendant received the total sum of KRW 9,911,000 from the victims through the aforementioned methods 21 times, such as the list of crimes in the attached Table (1) in the past, and took part in the transfer from the victims.

[2018 Madan339] On September 25, 2017, the Defendant acquired KRW 750,000 per day from the damaged person to his agricultural bank account, by means of false statement to the effect that, although the Defendant did not intend or have the ability to send the goods even if he received money from another person, he did not intend or have the ability to deliver the goods, the Defendant received KRW 750,000 per day from the damaged person to his agricultural bank account.

[2018 order 547] On September 15, 2017, the Defendant was transferred KRW 150,000 on the same day from the injured party’s agricultural bank account, on the ground that the Defendant made a false statement to the effect that, although he did not have the intent or ability to send goods even if he/she received money from another person, he/she reported the content that he/she would sell the goods on the website “C” to the victim G who had contacted him/her with the content that he/she would sell the goods.

The defendant shall be the defendant.
