All appeals by the Defendants are dismissed.

1. Summary of grounds for appeal;

A. The punishment sentenced by the lower court (5 million won of fine) is too unreasonable.

B. The punishment of Defendant B (a fine of three million won) sentenced by the lower court is too unreasonable.

2. Determination

A. Although Defendant A is not a person operating the game of this case, there are circumstances such as the Defendant’s confession and reflects on the facts charged of this case, the size of the game of this case is not small, the Defendant’s daily period does not seem to be a short-term position among the employees in the game room, and the Defendant appears to have been in a relatively important position. The Defendant’s operation of the game of this case, such as this case’s social harm, is deemed to require strict liability. In full view of all the circumstances, including the Defendant’s age, character, conduct, family relation, environment, occupation, circumstance and contents leading to the instant crime, and circumstances leading to the instant crime, etc., the sentence imposed by the lower court cannot be deemed to be unfair, and the Defendant’s above assertion is not reasonable.

B. Although Defendant B did not operate the game of this case, and the defendant appears to have worked in the game of this case according to Defendant A’s solicitation, the defendant led to confession and reflects the facts charged of this case, and did not have the same criminal records, the defendant does not seem to have a short period of time. The act of running the game of this case, such as this case, is deemed to have a significant social harm, and thus the defendant’s act of operating the game of this case requires strict liability. In full view of all the circumstances that are the sentencing conditions indicated in the records, such as the defendant’s age, character, character, family relation, environment, occupation, circumstance and contents leading to the crime of this case, and circumstances after the crime, the court below sentenced the judgment of the court below.
