A defendant shall be punished by imprisonment for not less than one year and six months.
Each of the facts charged in this case.
Reasons
Punishment of the crime
1. Forgery of private documents, uttering of falsified investigation documents, and false entry in a passport;
A. On March 24, 1999, the Defendant forged private document 1) around March 1999: (a) around 199, Jongno-gu Seoul, Jongno-ro 3 asked the “passer” under the name-based “B” to obtain a passport under the name-based name B; and (b) notified B of the name, resident registration number, etc. upon the Defendant’s request. On March 24, 1999, the passporter entered “name B”, “resident registration number C”, “applicant’s name B, etc.” in the Nowon-gu Office located in Seoul Special Metropolitan City, Nowon-gu, and attached the Defendant’s photograph after signing “B” in the signature column. Accordingly, on March 24, 1999, the Defendant forged one copy of the application for the issuance of a private document under the name B, which is a private document related to the certificate of fact; and (c) the Defendant, at the same time, submitted the genuine application for the issuance of the passport to the public official of Nowon-gu, who was not aware of the forgery.
Accordingly, the defendant exercised one copy of the application for issuance of a passport in B, a private document concerning a forged certificate of fact.
3) Around March 24, 1999, the Defendant submitted an application for the issuance of a passport under the above forged name B at the Nowon-gu Office, Seoul Special Metropolitan City Office, and submitted a false report as if the Defendant was B, and made a public official of Nowon-gu, who is unaware of such circumstances, issued B a passport under the name of the Defendant on March 25, 199. Accordingly, the Defendant made a false report to the public official and made him enter the false facts in the passport. (b) On December 14, 1999, the Defendant forged private documents 1) at the Seocho-gu Office located in Seocho-gu, Seoul Special Metropolitan City on December 14, 199, and Nonparty 1-1.
A. When the name B passport issued as described in paragraph 3 has been damaged, “Name B” is deemed to be an application for the issuance of a passport to be reissued.
