A defendant shall be punished by imprisonment for five years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

1. 성폭력범죄의처벌등에관한특례법위반(주거침입강간등) 및 성폭력범죄의처벌등에관한특례법위반(특수강간) 피고인은 2014. 5. 25. 07:10경 부산 사상구 C에 있는 D대학교 기숙사 E아파트 2층 동 호 피해자 F(여, 19세)의 주거지에 이르러 잠기지 않은 2층 베란다 창문을 열고 들어가 침입한 다음, 그곳 방안 침대에 피해자 F가 혼자 잠들고 있는 것을 발견하고 피해자를 강간하기로 마음먹고, 그곳 거실 주방에 있는 흉기인 총길이 약 20.5cm, 칼날 길이 약 11cm인 과도를 집어 든 채 침대 위에서 엎드려 누워 잠을 자고 있는 피해자의 허리 위에 올라탔는데 이에 잠이 깬 피해자가 몸을 일으키려 하자 피해자의 목에 칼을 대고 귓속말로 “조용히 해라, 니 때문에 행복해하는 주위 사람들이 니가 죽으면 얼마나 슬퍼할지 생각해 봐라.”라고 말하며 피해자의 입을 손으로 막고 얼굴을 밑으로 눌러 피해자의 생명이나 신체에 어떤 위해를 가할 듯한 태도를 보여 피해자를 협박해 반항을 억압한 다음, 피해자의 볼을 수 회 쓰다듬고 피해자의 두 팔을 뒤로 돌려 휴대폰 충전기 끈으로 묶은 뒤 피해자를 강간하려고 하였으나 피해자가 팔을 벌리며 묶인 휴대폰 충전기 줄을 풀고 피고인을 밀치며 도망가 그 뜻을 이루지 못하고 미수에 그쳤다.

2.
