The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. The defendant asserts that the judgment of the court below was erroneous in the misapprehension of the legal principle as to the defendant's patent insult of the victim by taking the victim's bath although he did not want the victim, which affected the conclusion of the judgment.
B. The Defendant asserts that the sentence imposed by the lower court (one million won of fine) is too unreasonable.
2. Judgment on the assertion of mistake of facts
A. The Defendant: (a) around 22:55 on January 25, 2014, the facts charged in the instant case: (b) on the ground that the victim E ( South and North, 43 years old) affiliated with the D Zone D District D District D District D District D District D District D District D District D District D District D District E asked about the details of the Defendant’s report of assault; and (c) on the ground that the victim E had the Defendant’s daily F, police officers, five police officers, police trainees, etc., the police trainee, the Defendant sent the victim E to the police guard, “the details of the traffic accident at the police station, and the flabbbro ky flab, which the police officer must go to the end of the accident at the police station, and the police officer’s flab flab, which the flab fom, to sarb off.”
B. The lower court found the Defendant guilty of the instant facts charged by compiling the evidence as indicated in its judgment.
C. Considering the difference between the first instance court and the appellate court’s method of evaluating the credibility of a statement made by a witness of the first instance court in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or there are extenuating circumstances to deem that the first instance court’s determination was clearly erroneous in light of the contents of the first instance judgment and the evidence duly examined by the first instance court, or that it is remarkably unfair to maintain the first instance court’s determination as to the credibility of a statement made by a witness of the first instance court by taking account of the results of the first instance court’s examination and the results of additional evidence examination conducted by the time of closing of arguments in the appellate court.
