Reasons
1. Details of the disposition;
A. On April 20, 2015, the Plaintiff filed an application for refugee status with the Defendant on April 2015, 2015, prior to the expiration of the period of stay ( April 22, 2015), when entering the Republic of Pakistan (C-3) and staying in the Republic of Korea on a short-term visit (C-3) sojourn on April 12, 2015.
B. On May 27, 2015, the Defendant rendered a decision to deny refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would be subject to persecution” as prescribed by Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol Relating to the Status of Refugees.

2. Whether the instant disposition is lawful
A. The Plaintiff’s assertion M&M conflicts money and valuables through kidnapping and intimidation to companies for the purpose of raising a legitimate fund.
From June 2014, the Plaintiff operated a wholesale company dealing with clothing and motor vehicle parts in Pakistan. On February 2, 2015, the Plaintiff was arrested by four members of QM on the road at the company’s office. They sent the Plaintiff a total amount and threatened the Plaintiff with a forest speed of 50,000 square meters.
The plaintiff was able to pay 500,000 U.S. dollars through big children.
In addition, on March 13, 2015, two QMs sought the Plaintiff on March 13, 2015, and demanded 2 million lux. However, the Plaintiff refused to pay money due to the lack of money, and received a intimidation call with the content of demanding money over 4-5 times thereafter.
Therefore, the Plaintiff constitutes a refugee.
Nevertheless, the instant disposition made by the Defendant on a different premise is unlawful.
