The prosecution of this case is dismissed.

1. On September 20, 2012, the Defendant assaulted C(68 years of age) the victim around 10:30 on September 20, 2012

2. The case is a crime falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. According to the written agreement bound in the trial records, it is apparent that the victim C withdrawn his/her wish to punish the defendant on March 15, 2013, which is the date of institution of the instant prosecution. Thus, the prosecution of this case is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
