A Imprisonment of 10 months, Defendant B shall be punished by a fine of 9 million won, and Defendant C shall be punished by a fine of 2 million won.
Reasons
Punishment of the crime
Defendant
A was sentenced to three years of imprisonment for fraud, etc. at the Incheon District Court on November 3, 2016, and the judgment was finalized on January 6, 2017.
1. On February 2, 2015, the Defendants’ joint crime: (a) requested Defendant B and C to the purport that Defendant A, a loan broker, who became aware of through the Internet advertisement, would be able to obtain a loan regardless of how they would be notified of the circumstances that it is difficult to obtain a normal loan due to the lack of a certain occupation; and (b) Defendant A would be able to accept the request and receive a regular benefit from the financial institution even though he/she did not have received a regular benefit due to his/her occupation; and (c) would be able to obtain a “work loan” from the financial institution by manipulating the details of the passbook transaction from the financial institution as he/she received a regular benefit due to his/her occupation.
Defendant B and C decided to actively cooperate with them.
A. The Defendant A and B prepared one copy of the statement of transactions in the passbook with each of the “H” around November 14, 2014, around December 15, 2014, and around January 15, 2015, as if the payment of KRW 1.8 million was made from each of the “H” around December 15, 2015, and submitted one copy of the statement of transactions in the passbook in the form of an image file to the employee in charge of the victim’s transactions. Defendant B did not receive benefits while working in “H,” and Defendant B did not have an intent or ability to repay the loan, and Defendant B was transferred from the said employee as if he/she had an intent and ability to repay the loan, despite having no intention or ability to repay the loan.
As a result, Defendant A and B conspireded to obtain 9 million won from the injured party.
