A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 5. 5. 18:30경 경기도 여주군 D에 있는 외 6촌 동생인 피해자 E(45세)의 주거지에서, 피해자가 피고인에게 이장직을 똑바로 수행하라며 전화로 욕설을 하였다는 이유로 피해자를 찾아가 ‘내가 뭘 잘못 했냐’고 따지며 서로 욕설을 하던 중 순간적으로 격분하여 피해자를 살해하기로 마음먹은 후, 그 집 부엌 선반 위에 있는 부엌칼(칼날길이 19센티미터, 총길이 27센티미터)을 집어 들고 도망가는 피해자를 뒤쫓아 가 그 집 거실에서 피해자의 왼쪽 손목, 옆구리, 겨드랑이, 등 부위를 각 1회 찔러 피해자를 살해하려 하였으나, 이를 발견한 피해자의 아버지인 F로부터 제지를 당하는 바람에 피해자에게 약 3주간의 치료를 요하는 개방창 동반된 외상성 기흉 등의 상해를 가함에 그쳤다.

Accordingly, the defendant attempted to kill the victim, but attempted to do so.
