1. The decision made by the Intellectual Property Tribunal on June 7, 2017 on the case No. 1896 shall be revoked.

1. Basic facts

A. On June 30, 2016, the Plaintiff filed against the Defendant on June 30, 2016, with the Intellectual Property Tribunal a petition for invalidation trial against the Defendant that “the nonobviousness of the instant patent invention claims 1 through 7 is denied since a person with ordinary knowledge in the art to which the invention pertains (hereinafter “ordinary technician”) can easily make an invention by prior invention 1 through 3 (see, e.g., Supreme Court Decision 201Da1896, Dec. 9, 2016).” (see, e.g., Supreme Court Decision 201Da1896, Dec. 9, 2016).

4) A request for correction such as correction under Paragraph 4 of the same Article (hereinafter “instant request for correction”).

(3) On June 7, 2017, the Korean Intellectual Property Tribunal rendered the instant trial ruling recognizing the correction and dismissing the said request on the grounds that “the instant request for correction is lawful, and there is no omission in the specification of the instant patented invention reflecting the content of the instant request for correction, and the claim 1 through 7 after the instant request for correction is filed on the grounds that the nonobviousness is not denied by prior inventions 1 through 3.”
