Punishment of the crime

1. On January 31, 201, the Defendant called, “Around January 31, 201, the victim B (n, 36 years of age) by using a mobile phone, and called, “No money has to pay a fine of KRW 3 million up to the increase of internal prices. If a person lends KRW 3 million to another person, the Defendant would receive KRW 10 million that he/she lent to another person on the following week.”

However, at the time, the Defendant had never lent KRW 10 million to others, and even if there was no specific property, there was no intention or ability to repay the money from the victim.

As such, the Defendant, by deceiving the victim, received 3 million won from the Agricultural Cooperative Account (Account Number C) in the name of the defendant on the same day from the victim and acquired it by deceiving the victim.

2. On February 14, 201, the Defendant made a phone call to the said victim B using a cell phone, and told the said victim B to the effect that “A vehicle requires 200,000 won of the registration fee for a vehicle to be transferred to a new name and to be used at the same time, and if the vehicle is not cash, it would immediately be repaid if it is lent 200,000 won.”

However, at the time, the Defendant did not think that 200,000 won will be used as the registration fee for the vehicle, and even if there was no particular asset, there was no intention or ability to repay the money from the victim.

As such, the Defendant, by deceiving the victim, received 200,000 won from the victim to the said agricultural bank account under the name of the defendant on the same day.

3. On February 16, 2011, the Defendant called the above victim B by telephone using a cell phone to the effect that “It does not have an oil value of 130,000 won in order to sell again to a person living in the region an automobile, which was intended to purchase and use, to the local area. It would be immediately repaid if 1.30,000 won are lent because there is no cash at the present.”
