A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

The Defendant is a professor of the Ethic Department of the Korean National University of North Korea.

A person who intends to conduct or participate in a national research and development project shall prepare a research and development plan stating the necessity for research and development, details of research and development expenses including personnel expenses, etc. and apply for a research and development task to the head of a central administrative agency or the head of a specialized institution. The head of a central administrative agency may organize the items of research and development expenses as direct and indirect expenses and contribute all or part of them. A person in charge of research and development shall not use research and development expenses for any purpose other than

Around May 2009, the Defendant: (a) prepared an application for national research and development projects and plans to pay the full amount of personnel expenses to the researchers who participated in the national research and development projects in the name of the researcher who participated in the national research and development projects while directly keeping a passbook in the name of the researcher whose personnel expenses are deposited; (b) submitted to the person in charge of the cooperation and development projects, including personnel expenses, and submitted from the person in charge of the industry-academic cooperation and cooperation foundation for the victims’ pre-North Korean University, which keeps the research and development projects, with the aim of individually acquiring the personnel expenses to be paid to the researchers in relation to the “F” registered by the Defendant as the responsible researcher; or (c) prepared an application for national research and development projects and plans to pay the total personnel expenses to the researchers who participated in the national research and development projects, and submitted from July 30, 2009 to the person in charge of the industry-academic cooperation foundation for the victims’ pre-North Korean University from July 30, 2009 to May 10, 18.
