나. 피고인은 2012. 9. 10.경부터 2013. 8. 20.경까지 위 E 마사지 업소에서 룸 7개, 샤워실 1개, 대기실 2개, 주방 1개, 화장실 1개를 갖추고 운영실장 B과 안마사 자격증이 없는 여종업원 G, H을 각각 고용하여 인터넷을 통해 ‘써비스 극강의 언니들 60분 5만발!!’이라는 내용의 성매매 영업 광고를 한 다음 위 업소를 찾은 불특정 다수의 남자 손님들을 상대로 6만원을 받아 피고인이 1만원, 여종업원이 5만원을 나누어 가지는 조건으로 위 여종업원들로 하여금 남자 손님을 상대로 약 40분간 안마를 하고 이후 약 20분간 손으로 손님들의 성기를 손으로 만지고 위 아래로 흔들어 발기시켜 사정하게 하는 방법으로 유사성행위를 하도록 하였다.
