피고인은 2018. 6. 11. 02:00경 안산시 상록구 B아파트 상가 1층에 있는 C 편의점에 들어가 바지 안에 손을 넣은 상태로 종업원인 피해자 D(여, 35세)에게 “56세 여자가 나보다 누난데, 자지를 잘 빤다. 내가 너무 잘해서 환장하더라. 10분 이상 했다. OO아, 너도 잘 하겠다.” 라고 말을 하고, 그 때부터 약 2시간 동안 물건 구입을 명목으로 수회 위 편의점을 출입하며 “그런 걸 너도 좋아할 것 같은데 ”, “OO아 울지마, 내가 널 지켜줄게, 사랑해.” 등으로 피해자를 희롱하는 말을 하다가, 같은 날 04:13경 위 편의점 내에서 피해자에게 “라이터를 사겠다.”라고 하여 피해자가 손으로 라이터를 집자, 갑자기 피해자의 손등 위에 피고인의 손을 얹고, 계속하여 피해자의 손 전체를 피고인의 손으로 감싸며 만져 피해자를 추행하였다.
